九十四學年度第一學期刑法分則課程大綱

內容：
一、課程內容
本課程目的是在同學們暸解刑法上犯罪基本概念之後﹐進一步進入各個不同犯罪類型的認知。講授內容涵蓋刑法所規定的侵害個人法益的犯罪、侵害社會法益的犯罪以及侵害國家法益的犯罪。不過由於時間的限制﹐對於刑法所規定的全部犯罪類型﹐會稍作取捨。具體章節大致上包括【侵害個人非財產法益】的殺人傷害墮胎遺棄妨害自由妨害名譽及信用及妨害祕密罪。【侵害個人財產法益】的竊盜搶奪、強盜侵占詐欺背信及重利恐嚇、擄人勒贖贓物及毀損罪。【侵害社會法益】的公共危險偽造貨幣偽造文書印文妨害風化、賭博、毒品罪等。【侵害國家法益】的瀆職妨害公務妨害投票妨害秩序藏匿人犯及湮滅證據偽證以及誣告罪。

Subject: Criminal Code – Kinds of Offenses

Syllabus

I. COURSE DESCRIPTION
This course is intended to advance students’ knowledge about various kinds of offenses, after learning the basic principles of criminal code. The course will cover offenses involving danger to the person, offenses against property, offenses against the society, and offenses against the state. However, due to the limitation of time, this class will not teach all types of offenses. The topics that will be discussed include: Offenses Involving Danger to the Person (Homicide, Assault, Abortion, Abandonment, Restraining One’s Liberty, Obstruction of Reputation and Credit, Intrusion to Privacy) ; Offenses against Property (Theft, Muggings, Robbery, Embezzlement, Fraudulent Practices, Extortion, Kidnapping, Receiving and Selling Stolen Property, Property Destruction); Crimes against the Society (Danger to the Public, Forgery, Forging Documents and Seals, Public Indecency, Gambling, Narcotics); Crimes against the State (Abuse of Office, Obstructing Governmental Operations, Disorderly Conduct, Interference of Voting, Destruction of Evidence, Perjury, False Accusation).

III. EVALUATION
Students’ grades will be based on the result of the final examination.

VI. QUALIFICATION IN THE CLASS REGISTRATION
Students in the Graduate Institute of Interdisciplinary Legal Studies have taken all courses in Criminal Code – the General Principles.
